Terms and conditions
The agreement between you and Terroirsbookings when you subscribe to POPIA Ready.
Last updated 31 August 2026.
1. Who you are contracting with
The service is supplied by Terroirsbookings ("we", "us"), a business registered in South Africa.
- Registration number: 2026/101900/07
- Address: 44 Wellington Road, Centurion, Gauteng, South Africa
- Email: gregory.dearham@gmail.com
These terms apply from the moment you create an account. If you do not accept them, do not use the service.
2. What the service is — and is not
POPIA Ready is software. It takes information you supply about your own business and generates a PAIA manual and a POPIA privacy policy from it, provides a consent banner for your website, and keeps a record of the consent choices your visitors make.
We are not a law firm and we do not provide legal advice. Nothing produced by the service, and nothing said by us, is legal advice or a legal opinion on your circumstances. Legal practice in South Africa is regulated, and we are not entitled to practise it.
If you are dealing with a complaint, an investigation, an enforcement notice, or an unusual corporate structure, you need an attorney. We will tell you so.
3. Your answers are your responsibility
The documents are generated from what you tell us. We do not verify your answers, and we cannot: only you know what personal information your business holds, why, and for how long.
You are responsible for the accuracy and completeness of what you enter, for reviewing the generated documents before you rely on them, and for updating your answers when your business changes. A document generated from wrong answers will be wrong.
4. Fees and payment
- R800 per month, or R8,640 per year paid in advance.
- Payments are processed by Payfast. We never see or store your card details.
- Prices are in South African Rand.
- We will give you at least 30 days' notice by email before any price increase, and you may cancel before it takes effect.
If a payment fails we will email you and your service continues for a short grace period while you fix it. If it is still unpaid after that period the banner stops being served and the account is suspended. Your data is not deleted when this happens.
5. Cancellation and refunds
You may cancel at any time. There is no contract term and no cancellation fee. This is set out in full in our refunds and cancellation policy, which forms part of these terms.
6. Personal information and our role
For the consent records collected from your website, you are the responsible party and we are your operator under sections 20 and 21 of POPIA. That relationship requires a written contract, which you accept when you create an account and which is separate from these terms.
For your own account details — your business name, your Information Officer, your billing information — we are the responsible party. How we handle those is set out in our privacy policy.
7. Availability
We will take reasonable steps to keep the service available, but we do not offer a guaranteed uptime level at this price and we do not promise the service will be uninterrupted or error-free. Planned maintenance will be notified in advance where we can.
The consent banner is designed so that if it cannot run safely on one of your pages, that page is served exactly as it was rather than broken. That means a failure of ours may allow a tracking tag to run.
8. Your data belongs to you
Your questionnaire answers, generated documents and consent records remain yours. You can export your consent log as a spreadsheet at any time, including after you cancel, and the documents are PDFs you already hold.
We will not sell your information, and we will not use your consent records for any purpose of our own.
9. Acceptable use
You may not resell or relicense the service without a written partner agreement, present it to anyone as legal advice, attempt to circumvent the account or rate limits, or use it to generate documents for a business you have no authority to act for.
10. Liability
Nothing in these terms excludes liability that cannot lawfully be excluded, including for death, personal injury, fraud, or anything the Consumer Protection Act does not permit us to exclude.
Subject to that, our total liability arising out of the service in any twelve-month period is limited to the fees you paid us in that period. We are not liable for a fine, penalty or enforcement action imposed on you by a regulator, for loss of profit, or for any loss arising from information you supplied that was inaccurate or incomplete.
11. Suspension and termination by us
We may suspend or close an account for non-payment, for a breach of clause 9, or where we are required to by law. Except where the law requires immediate action, we will tell you first and give you a reasonable opportunity to put it right, and you will be able to export your data.
12. Changes to these terms
We may update these terms. Material changes will be notified by email at least 30 days in advance, and continuing to use the service after that is acceptance. If you do not accept a change, you may cancel.
13. Governing law
These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction.
14. Getting hold of us
Email gregory.dearham@gmail.com. A complaint reaches a person, not a queue.
